WHAT IS SIBRAA GROUP LTD?

SIBRAA GROUP, LTD (Southern Idaho Business Risk Assessment Associates) is a non-profit Idaho Corporation formed in October of 2002. The following firms are charter member of SIBRAA Group, Ltd:

The exchange of commercial credit experience is a legal activity when the meetings are properly conducted. SIBRAA Group, Ltd. offers such an opportunity.

SIBRAA MEMBERSHIP CONDUCT GUIDELINES

Purpose of these guidelines:

SIBRAA provides a forum for the collection, compilation and exchange of credit experience and information and to discuss trends and improvements in credit management techniques and other subject of general interest. It is the intent of SIBRAA to engage in this endeavor in full compliance with applicable law, regulations, and ethical standards. The purpose of these guidelines is to assist SIBRAA and the individual members in accomplishing these goals.
 
If there is ever any question with regard to the propriety of certain conduct by SIBRAA or its individual members, regardless of whether such conduct is specifically addressed by these guidelines, the matter should be promptly directed to the attention of SIBRAA and the membership. Awareness and responsiveness to changes or developments in law or ethical standards will help to avoid potential liability as well as to achieve the goals of this organization.

What SIBRAA Group members may do:

  1. Exchange, at Group meetings or in written reports, current factual information relevant to the credit history of commercial accounts. This information should be based on the actual experience or present knowledge of the member.
     
  2. Report on actual delinquent commercial accounts by identifying the name and address of the debtor, and a statement of the amount owed.
     
  3. Discuss general trends or conditions in industry or the economy.
     
  4. Engage in collective support or opposition to legislation of direct interest to the Group or its members.

What SIBRAA Group members may NOT do:

  1. Directly or indirectly engage in or participate in any agreement or understanding, express or implied, with any other SIBRAA member or members to: i) fix or determine to whom sales are to be made or to whom credit is to be extended; ii) establish joint or uniform prices, terms, or conditions under which sales are to be made or credit is to be extended; iii) create any other uniform or standardized rates or practices among any SIBRAA members; or iv) limit production or establish quotas, divide markets, or boycott or blacklist customers or suppliers.
     
  2. Directly or indirectly exchange or collect information amongst any SIBRAA members as to prospective prices, credit policies, terms or conditions of sale, or production costs or plans.
     
  3. Directly or indirectly participate in or give consideration to any activity, plan, understanding, or arrangement, which would restrict or interfere with the exercise of free and independent judgment by the Group members in the management or operation of their respective companies.
     
  4. Provide, share, or disclose information with respect to any credit account without, prior to disclosure and circulation to SIBRAA or its members, verifying that the END USE of any such credit was NOT primarily for personal, family, or household purposes. Such confirmation requires verification of the ACTUAL end use. A creditor’s motives in extending credit are not, alone, sufficiently dispositive of this inquiry.
     
  5. Disclose, confirm, deny, or otherwise discuss with any non-member information pertaining in any way to any report, or lack thereof, as to any debtor or credit account.
     
  6. Directly or indirectly use the fact or benefits of membership in SIBRAA to, in any way, collect outstanding debts. The prohibition contained within this subpart includes, but is not limited to, using the threat of reporting or withholding information pertaining to a debt from SIBRAA or its members.
